I like the theory of this because of the potential for some of the most idiotic lawsuits known to mankind. If the baybee is pulled out to sea in an undertow then the parunts are stuck trying to sue the ocean. Or if there happen to be sharks nearby who smell blood and eat the baybee, sue the sharks. Or sue a school of fish for touching the baybee. And good luck with that. But realistically who wants to witness or be swimming around in that?
