Rhode Islanders are asking this question in light of a sentence handed down to 17-year-old Lyle Topa last week. The teen was racing in October and slammed into a tree, injuring himself and three others. He was driving on a suspended license at the time and had just left a party where he and his friends had been drinking.

When asked about the lifetime ban, Judge William Guglietta explained that it was time to get serious about teen drivers who have become a real danger on the road.

A number of Rhode Island lawmakers think the lifetime driving ban goes too far, reports the Boston Herald. Lifetime bans are for repeat drunken drivers, not teens who may mature into responsible adults.

This may be true, and is an argument likely to be made if Lyle Topa chooses to appeal his sentence. Sentences are supposed to be proportionate to the crime and, when they involve minors, appropriate for the age. While the teen was accused of illegal racing, driving on a suspended license and driving while intoxicated, he's still a minor. A lifetime driving ban doesn't necessarily take into account his immaturity.

If the state's higher courts disagree, Topa still has other options. At some point in the future, he can ask the court to reduce his sentence, explains the Westerly Sun. But before he can do this, he will probably need to get his life in order -- stay out of trouble and maintain a steady job or be in school. He'll need to prove that he has learned from his mistakes and is now a responsible member of society.

If he can do this, the chances of Lyle Topa remaining on a lifetime driving ban are pretty slim.

The retard got what he deserved. He will not mature, he'll simply try and act like he has to appeal the sentence, then eventually go back to being Moron McDumbass, probably just to spite the judge.

Repeat drunk drivers? He was drunk, underage, when he crashed. He is off to a great start on the DUI frequent flyer program.

OK, if you are old enough to drive, you are old enough to accept the consequences when you fuck up while driving. Minor, my ass. He broke the law trifecta here, he did not get caught going 5 miles over the speed limit.

A driving ban does sound like a good idea, but I bet that someone at age 17 who is dumb enough to race while drunk on a suspended license will probably have NO problem driving, even if banned. I think there should be some immediate jail time, followed by a driving ban. There need to be unpleasant consequences for this kind of stupidity.

Good thing he was banned, although I'd like to see stricter punishment given Tiquer's point. This dipshit needs to be shown that even though he's not an adult and young and stupid and "didn't know any better" or whatever the fuck, there are consequences for stupidity. He needs to be an example.

Frankly, if asswad teen had been REALLY punished the first time he stepped out of line, he might not be where he is today. That is the problem: they are given leniency because it is their first time and it does not teach any lesson. His parunts may be asswipes themselves. This bastard has been in trouble enough times they revoked his driving priveleges. Obviously has not learned a damn thing.

Dysfunctional relationships almost always have a child. The more dysfunctional, the more children.

Well, the moron has proven he has no issue driving with a suspended license, so I'm sure he'll have no problem driving without one at all. Not being allowed to drive for legal reasons sure as fuck has never stopped someone from getting behind the wheel and driving to work or McSlop or what-not.

I'm sure he'll kick and scream and bitch and go to the media until it gets appealed because that's what brats do - have atomic tantrums until they get their own way. Then he'll go get fucked up and treat downtown like a drag strip again because he will have learned nothing.

I don't think it is going overboard. The kid is showing flagrant disregard for laws meant to protect others from morons such as him. How many teens are killed from drag racing and/or drinking? How many others are killed? We are not talking about him walking along smoking a joint-he is supposed to be navigating a 4000 pound vehicle. The consequences can include death for himself or others. And the fact they yanked his license already and he is still doing it shows how seriously he takes this. Driving is a privilege, not a right. Maybe he can revisit this at age 40. Right now, he is not competent.

Breeders fail to realise that some actions have permanent consequences, and it doesn't matter if someone is immature when they perform the action. Walk along the traintracks listening to music, and the train isn't going to suddenly freeze a few inches away because you're under 18. Swallow handfuls of magnets as a toddler, and you'll probably have stomach problems for the rest of your life.

Prove that you're a total dumbfuck by behaving like this ass--where sheer luck is the only thing that has kept him from killing himself and others--and you deserve permanent consequences (well, maybe when he's lived the same amount of time again as it's taken him to get this far they can reconsider the penalty).

Perhaps the lifetime ban could be reviewed when he reaches, oh, age 35 or so. Until then at least, too bad, stupid, you got what you earned.

We in the US, where in most states receiving driver's licenses as young as 16 is usual, tend to forget that the driving age in most other industrialized countries is 18. Some states have changed to "graduated" licensing that does not allow full privileges until about 18, but there seems to be no really good reason not to simply make the driving age 18 across the US as other countries have done. Maybe Lyle Topa wouldn't have had the opportunity to rack up so many violations and place so many other people at extreme risk.

John Rosemond, the parenting guru, has long advocated such a change in the minimum driving age. He said some years ago that today's 16–year-old is only about as mature as a typical 12–year-old of past decades, so we should not be allowing them to drive. Topa is an example of what Rosemond means.

And more important, he said, is the fact that when the laws were written about a century ago, neither cars nor roads allowed for high speeds - and kids didn't waste valuable gas money just to drive for fun. Nowadays.......

Unfortunately, they won't be able to enforce this. He's already proven he doesn't give a damn about the law. He sure is not going to stay off the roads when he's 20 as the judge commands.

"Lifetime bans are for repeat drunken drivers, not teens who may mature into responsible adults."

yeah, he could get away because he's legally a teenager. bitch please. he's only one year away from legal age of consent.
will someone turn 18 in his birthday and BOOM suddenly mature into responsible adult? This reasoning is stupid.

if I'm not mistaken, isn't legal driving age in USA 16? Boom. someone's old enough to be responsible while driving. let's ban the driving license, yaayyyy!

"A number of Rhode Island lawmakers think the lifetime driving ban goes too far"

"lifetime" could be shorter than they think if he sneaks behind the wheel again...

Pah, the shit will drive anyway. I work in a misdemeanor court....a huge portion population doesn't have a valid license, doesn't have insurance - they drive regardless.

Too bad he couldn't be ordered to work full time, pay-free, in a head trauma ward or some such place until he reached the age of 21. Sick of these spoiled brats who have too easy of a life and have things handed to them acting like fools.

What has astounded me in this context is the number of clueless pahrunts who will gladly buy Junior a new sports car or SUV after he's already amassed tickets and had accidents. Out my way there was a rash of such cases that came to light after the kyd wrapped said new sports car around a tree at 120 mph or rolled said SUV several times at high speed. At some point the pahrunts must be held accountable for continuing this enabling behavior.

I wish California judges would learn a thing or two from the Rhode Island judge! We have so many problems with drunk driving by teenagers and the unlicensed in LA that it sometimes makes one wonder if going out at night is worth it. Between the drunk and reckless driving, the racing and the crime, southern California is turning into "Escape from LA" ala John Carpenter style.
