Charges were announced Tuesday against three California employees in the death of a student with special needs, CBS Sacramento reports. Guiding Hands School, Inc. Executive Director and Site Administrator Cindy Keller, Principal Staranne Meyers and special education teacher Kimberly Wohlwend each face one charge of felony involuntary manslaughter for the November 2018 incident.

Thirteen-year-old Max Benson died after reportedly being restrained by staff due to violent behavior. He eventually became unresponsive. Authorities said a teacher performed CPR, but Benson died two days later at the UC Davis Medical Center.

The California Department of Education later suspended Guiding Hands School, Inc.'s certification and it was closed. The agency found that the school violated state rules when its staff put Benson in a face-down restraint position for nearly an hour.

The private school in El Dorado Hills is also facing a count of felony involuntary manslaughter. The El Dorado County district attorney's office issued a statement saying the case was filed "after a lengthy, multi-agency investigation into the facts and circumstances that led to the death of [Benson]."

All three defendants will be arraigned Wednesday afternoon.

According to some other articles on this, the kid spit on a classmate and then got violent and he had to be restrained for an hour and 45 minutes, after which time he lost consciousness and while he was revived, he didn't survive for some reason. Also, this happened a year ago, so why's it news now?

The kid went to a tard school, and I imagine he must have really been on the warpath if he had to be restrained for that long. What was the alternative? Let him flap around and injure all the other kids/staff? Lock him in a room and let him destroy it so Moo could proceed to not pay for the damage because "he's just a chiiiiild?" I hate to say it, but a kid this violent probably would have genuinely hurt someone sooner or later and maybe it was for the best he won't be able to do that now.

I really want to hear the teachers' side of all this because the news coverage just kinda makes it sound like the teachers were just being mean to the poor innocent widdle dumpling. My guess is there was a good goddamn reason they had to restrain him that much. Of course, sympathy has been pouring out with people holding candlelight vigils for the kid and mailing his mother rocks because he loved rocks. I'm surprised there's no GoFundMe to raise money for tard abuse awareness or some shit.

I used to teach in a public elementary school. I’ve had a few of these kids in my class. Two things:

1) If a normal kid hits another kid, the kid will get a write up and a punishment (the punishment will depend upon how many other times the kid has been written up). If a a spec ed kid that’s pretty much normal hits another kid, s/he will get written up and punished. If a severe spec ed kid hits another kid, nothing will happen. I once had a district office employee in my room observing one of the severe kids. The kid started pushing and slapping, so I raised my voice and told him to stop. I was admonished by the district office employee for raising my voice and telling him no, because apparently that was one of his triggers as listed in his IEP. Apparently the correct solution would have been to allow him to keep hitting the other kids while I quietly and calmly asked him to please stop and tried to distract him with some other activity. All the physical stuff gets swept under the rug. I’m convinced that normal parents have NO IDEA what goes on in these mainstreamed classrooms, or how often their children get caught in the crossfire.

2) If a kid is really out of control, you are supposed to “clear the room,” which yes, is essentially locking him in the room. You’re supposed to gather up all the other kids and all of you make a quick exit, and then shut the door and let the out of control one go to town. And no, the parents are not responsible for the damage the kid causes.

They find out when their kid comes home injured. We've had a few incidents like this, where the local news media is reporting on kids that were assaulted by these out of control tards. The school does nothing and it goes to the media.

Public schools are fucked now thanks to bad parenting, mainstreaming, no Chyyyyld left behind, asshole parents who pressure administrators, not backing up teachers, and child-led bullshit.

One of my co-irkers has a violent on the spectrum son. This is exactly what they do. When he has one of his "rages," they clear the room and let him tear it up. He's SEVEN years old and they call the police. They are gentle discipline people so he's not told "no," he's just "presented with different choices," and all this other pop-psychological bullshit that parents are embracing these days. Despite all the alternatives he's "presented," his favorite choice is to hit his mother.

I strongly suspect if these violent tards got a few real beatings—I mean mob-style beatings within an inch of their lives—for their behavior, even they would learn and that behavior would stop.

In fact, you have to wonder what would happen if one day a violent tard assaulted, say, a Mafioso's kid in school. I'll bet that problem would get solved in a way the tard's parents won't like. Amazing that hasn't happened yet.

I wish I could say I'm surprised, but at this point, I'm not. I know by now that schools will bend over backwards and put students and staff at risk to avoid making a single kid or parent butthurt. Can't tell the fuckers no or use negative reinforcement or make them sit in a corner or take away their recess because it causes emotional trauma or some bullshit. Should it not be obvious by now that all this gentle crap doesn't work? Kids don't need redirection, distraction or choices, especially not tards.

I think "no" is every kid's trigger. What fucking planet are these people from? I feel like kids need to learn self defense before enrolling in school at this rate. I mean yes, any normie kid that defends themselves against a rampaging tard is going to probably get suspended, but to me, a kid fighting back and putting a violent asshole in their place is far better than sitting there and taking it because some fuckbag in the main office says they should. I'd bet if the principal or superintendent had to deal with these lunatic kids directly on a daily basis and try to make them behave, they'd make some new goddamn rules.

There's no more fear of authority in school because there's no more fear of it at home, so kids act however they want and know they won't face any consequences, so they have no reason at all to behave. They don't know what shame is, so they don't know how to be ashamed of themselves in front of their classmates.

Give it time. Soon no one will want to teach no matter how much it pays and parents will have to homeschool their little sentient cumstains. I think the whining will register on the Richter scale.
