Good for you! What a jerk for thinking you wouldn't mind it if the contractor ruined your yard with the bulldozer to build a pool for his brats! Of course he didn't ask you first, he had to know that any reasonable person would say NO. You were smart to fence in your yard when the Breedersons moved in. Keep the doors and gates locked! What complete jerks!

This is why when I buy another home, my neighbors will be either state conservation land or an Interstate highway. I want that SOLID guarantee that subdivisions will not spring up in my backyard. Been there, done that. Subdivisions are the worst - kids galore, and the dumb parunts gossiping endlessly. Clueless, brainwashed by society, and living the lie of having children is "oh so wonderful!" What's so wonderful about cartoons on the tv all the time, no sleep, a minivan/smoov (what sexy wheels you have parunts), and a constant mess to clean? Back to the post, I wouldn't hesitate to call the police, and file a restraining order if necessary. Typical duh, being a duh - I'll walk all over you because I have kyds. If you own a gun, and he comes in your home again, you are within your rights to protect yourself, and I'm a big supporter of people protecting themselves - winking smiley

Good for you for putting up that fence, and stating your chance, and standing YOUR ground. Of course breeder shit doesn't give a f*cking damn if he ruines YOUR yard, while he doesn't have to pay a dime. Keep your head up. You won.

Dude, you ROCK!!!!!!! I am so happy for you that you stood your ground.

Please be aware though, that they will probably now, try to make your life a living hell. I hope it doesn't come to that but you know how breeders are. Be prepared to start documenting. I like CFBoston's gun idea, buy some of those stickers that say "This property protected by Smith & Wesson" LOL Asshole breeder duh.

My next house is going to be right smack in the middle of a 10,000 acre cemetary. Best neighbors in the world.

Good for you for not giving in. This guy sounds like a real jerk. I would be totally pissed if I had someone in this neighborhood wanting to go through my fence, as well. As much as that jerk says he will replace your landscaping, you know jerks like that never come through, or if they do it wouldn't be up to standard that you had it.

He probably will try to make your life hell now. Is there another route the bulldozer could take? Perhaps through another breeder's yard?

Excellent idea! I agree with the others that the Breedersons will probably try to make your life a living hell. That's just the breeder way. What I don't get is why anyone, childed or not, would assume that their neighbor's home/property was open for their use whenever they wanted. What the hell was he thinking?

Don't you know? EVERYONE's yard is free access to the neighborhood brats. I have a constant problem with brats sleigh riding down the hill behind my house into my yard. They crash into my house, have broken siding and do they care? Nope. Last year, one of the brats came down the hill and smashed right into my gas meter, split their mouth all open, blood everywhere. It was SWEET. These people put in a pool last year, maybe SO and I will go up there some night and help ourselves to it. If they ask what we're doing I'll say, "Well, since you don't mind you kids using my yard all the time to sleigh ride in, I figured you wouldn't mind my using your pool." Assholes.

Yes, I remember the feelmypain guy, I immediately thought of that when I read the post here. I hope it doesn't resort to that.

I really hope that bastard won't turn into the psycho neighbor from hell, now - though, yeah, it wouldn't surprise me at all. Breeders can become incredibly nasty and vicious when they don't get their way. They're so used to society kissing their ass - so how DARE you stand up to them?!

I'm a big supporter of people protecting themselves and their property, too! It's one of the things I love most about living in Texas-a lot of other people feel the same way.

If your yard is completely surrounded by the 9 foot fence, then I wouldn't worry about the Breederson's "making your life hell." If you just ignore them, I don't see what they could do besides just being loud in their own backyard. In that case, other neighbors will probably complain, and they have a right to under local nuisance laws. I don't see how they could legally force you to grant them some kind of easement to build the pool. If they do harass you, I agree with the comment about documenting everything. If you suspect that they will damage your property, take photos of the damage and call the police. Don't worry, you will win this one!

Right on!! You need to some pro-guns signs and stickers around your house. Be seen outside by your neighbors sharpening your machete and grinning manically. Act like a lunatic and they will stay away! Duh sounds like major jack-ass and good for you!

I feel horrid for you if/when they do get a pool. There will be constant shrill kid-screaming and noise all the time. So much for enjoying a peaceful afternoon or evening with the windows open or out on your porch. I hope I'm not painting too morbid of a picture of what's to come, but listening to screaming kids all day would bug the living shit out of me. I'd pray for rainy days.

Guest, since you have a fenced-in yard, you might want to invest in a German Shepard to 'guard it'. If you know what *I* mean. winking smiley smiling smiley grinning smiley German shepards can come in handy. The breedershitsons will be scared shitless when the dog barks at them with BLUE MURDER.

Early this evening, a gentleman knocked on my door and identified himself as the county building inspector. He showed his identification and asked to speak to me. I stepped outside, not knowing what to expect. Then he asked me about my neighbor and the swimming pool excavator incident. I told him what happened and he then asked me if I had ever received communication from the asshole duhddie about it. I told him that I had no telephone calls, written communication like email or old snail mail or anything from him indicating that he would need to use my side yard. The inspector wanted to see the side yard and what the excavator would have needed to do his job. After that, he asked me a few more questions and complimented me on the landscaping. Just to make sure, I asked him about my fence, and he assured me that there were no county or township laws against it and I was perfectly within my rights.

It also turns out that asshole duhddie is in major trouble. He did not file for a building permit, he was using an unlicensed contractor, he did not post the required bonds for the job and he failed to notify me as required by the county's ordinances. The inspector told me that the police had called him when they noticed that no building permit was publicly posted, as required, on the property where work was being done. So the building inspector checked it out and no permit was on file. He also checked the contractor and could not find a current license. Duhddie had also not filed for the required sewer and water permits for this proposed swimming pool required by the state's water conservation laws passed a few years ago during a bad drought. So now, duhddie is facing thousands of dollars in fines.

Knowing our county attorney the way I do, duhddie will spend a lengthy amount of time trying to straighten it all out, and the county will not make it easy for him. For better or worse, they make the lives of scofflaws like duhddie practically miserable and he will definitely not have his building permit for at least until the end of summer, if ever. The county and township clerks are both vindictive people, and they don't like this kind of crap.

Looks like your brats will be pissing in the public pools this summer, duhddie asshole!! And the police recommended that I consider installing some motion-sensitive lighting to make sure duhddie doesn't try anything stupid.

I hope the asshole has to chew through his pool construction money with all of the fines. Either that or he will have to hire an expensive lawyer to help him with the county. I don't care, as long as he doesn't build that fucking pool.

I'm so happy for you that they won't be getting the pool, at least not anytime soon. It's bad enough that they live next to you anyway, but a pool guarantees that every damn kid in the neighborhood would be there every sunny day screaming and screeching their heads off. I swear to God if I had to listen to that every day, I'd be addicted to benzodiazepines.

I am glad this is working out for you, Guest. Scary thing is that breeders tend to have all of these "right". I have heard of eminent domain where a school can take over a business or another property by claiming something like tax rights. Someone please correct me if I am wrong...

Like CF Boston, Gracem and a few others here, I am VERY much pro-protecting yourself via a gun even though I am a "yoga-peace loving" person and considered this "tofu" dippy liberal. However, the longer I am alive and look at how I suffered from abuse as a child, teen, & young adult, I have NO problems with gun ownership and protecting ourselves. I guess I the "liberal who got mugged"...

Eminent domain actually allows the government to take over property for any reason, schools, roads, or even another more "desirable" business. In my town, the city government tried to take over a whole bunch of properties, including a porn store which has had zero police calls in the past two years, because a more desireable business (another office park! whee!) wants to move in there, and they want to gentrify the neighborhood so it's nicer for the suburbanites who now want to live in the city again.

Great update! My husband is a county engineer, and LOVES screwing jerks who don't properly file for their permits! THe gov't can really string a project out and empty your pockets with fines, if you don't follow their rules. Hopefully he isn't someone with connections of any kind, unfortunately those types usually get looked after by the gov't higher ups. Glad to hear of his misfortune!

I'm glad to hear that your neighbor is getting what he deserves for being such a jerk to you. I think eminent domain only applies when the government (vs. a citizen or private business) wants to take your property. It sounds like your neighbor can't afford to hire a licensed contractor or pay for the required permits, so my prediction is that he will give up on the pool due to lack of money.
