Slippery slope. Let this fucknut get away with the action and it will become a tool for others to harass women who have had abortions (though in this case, the woman says she did not).

ALAMOGORDO, N.M. – A New Mexico man's decision to lash out with a billboard ad saying his ex-girlfriend had an abortion against his wishes has touched off a legal debate over free speech and privacy rights.

The sign on Alamogordo's main thoroughfare shows 35-year-old Greg Fultz holding the outline of an infant. The text reads, "This Would Have Been A Picture Of My 2-Month Old Baby If The Mother Had Decided To Not KILL Our Child!"

Fultz's ex-girlfriend has taken him to court for harassment and violation of privacy. A domestic court official has recommended the billboard be removed.

But Fultz's attorney argues the order violates his client's free speech rights.

"As distasteful and offensive as the sign may be to some, for over 200 years in this country the First Amendment protects distasteful and offensive speech," Todd Holmes said.

The woman's friends say she had a miscarriage, not an abortion, according to a report in the Albuquerque Journal.

Holmes disputes that, saying his case is based on the accuracy of his client's statement.

"My argument is: What Fultz said is the truth," Holmes said.

The woman's lawyer said she had not discussed the pregnancy with her client. But for Ellen Jessen, whether her client had a miscarriage or an abortion is not the point. The central issue is her client's privacy and the fact that the billboard has caused severe emotional distress, Jessen said.

"Her private life is not a matter of public interest," she told the Alamogordo Daily News.

Jessen says her client's ex-boyfriend has crossed the line.

"Nobody is stopping him from talking about father's rights. ... but a person can't invade someone's private life."

For his part, Holmes invoked the U.S. Supreme Court decision from earlier this year concerning the Westboro Baptist Church, which is known for its anti-gay protests at military funerals and other high-profile events. He believes the high court's decision to allow the protests, as hurtful as they are, is grounds for his client to put up the abortion billboard.

"Very unpopular offensive speech," he told the Alamogordo Daily News. "The Supreme Court, in an 8 to 1 decision, said that is protected speech."

Holmes says he is going to fight the order to remove the billboard through a District Court appeal.

I think the chick had the abortion but can't/won't say it to protect herself (I'm sure she's been harassed by others). The assface is a member of the Bat-piss church, notorious Bat-piss fundies and assorted crazies that align themselves with white supremacists and oligarchs. I'm sure the dude is attention whoring to looks good before parishioners so he could further elevate his standing in the church and its VAST social stratosphere (he could be a businessman or professional).

Reading through the comments to that article, the woman this dreg has targeted might not be protected because of free speech, but the turd may well face violation of HIPAA laws. I hope she finds some way to tack his ugly puss to the wall angry flipping off

And gods, what an ugly hunk of shit he is - can I venture a guess that the sex he had with his girlfriend was not consensual? He's probably pissed off because his proof of getting his cock wet was taken away, either by nature or by a doctor. What a fuckbag - while it may take two to make a loaf, the fetus is not in his body, so he doesn't get to dictate whether or not it gets born. Really? It's protected free speech to stalk your ex and make a billboard about a very personal health choice you disagreed with? I bet if it was about any other aspect of one's health, no one would have cared. This is a warped interpretation of free speech. There are too many harassment and stalking cases to even begin trying to name where the offender's "free speech" was considered illegal and this is CLEARLY one of those cases. "Free speech" doesn't include slander and libelous acts NOR does it give criminals the right to indirectly violate restraining orders and get away with harassment. I can't imagine that any judge would rule in his favor.

I don't care if she miscarried or had an abortion ...what this guy is doing is wrong. I can't help but think this guy is an abusive asshole and now he's hiding behind 'his wights' to further abuse this poor woman.

At some point something is going to have to be done with all these fundies trying to make everyone live by their rules. Where's the line, what's going to be the last straw? It should have been when women were being harrassed trying to get into PP. It should have been when the first pharmacist refused to fill out a woman's bc prescription. It should have been when that asshole taxi or bus driver thought a woman was trying to get to PP and refused to let the women out at her stop. Note to females: Beware of older guys, particularly those who want to do things for you and make decisions for you. I know it might seem "sexy" to have a guy take care of you, but they could also turn into controlling assholes, like this tool.

Dorisan, HIPAA applies mainly only to health-care workers and others with legitimate access to health records. It doesn't apply to Joe Blows like this idiot.

The First Amendment does not generally proscribe speech (stop it in advance), but it also does not say that the speech cannot have consequences after the fact. His ex can go after him civilly for libel, invasion of privacy, and possibly other grounds, and even as a non-lawyer myself, I'd suspect she'd have a great case for collecting from the turd. And in my book he is a turd, just as Dorisan said.

I'm no fan of abortion, but if she really did have one rather than carry his child to term, I can't blame her!

The more I learn about this, the angrier I get. Turns out this asshole is a bully and an abuser, and has been stalking and threatening her. He also has a website (or websites) with pictures of her...when they were together and when he was stalking her. Hello? Isn't that evidence that he ain't right in the head? Good fucking god!

He's mad because he doesn't have anything to control her with. Abusers like to push for kids rather quickly...so they can use the kids against their victims.

His lawyer is going to have to do some fancy footwork to explain away the websites, the pics and now that fucking billboard. Free speech, my ass. I hope this woman is someplace safe, because this guy has upped the ante. It's possible that he doesn't know where she is, and this was his way of trying to find her.

ITA with using a billboard about him, except tell people "this is the face of an abuser".

If she's mentally disabled, they need to look into whether he's violated consent laws and how old she was when the relationship started. If they can prosecute his ass for it, they should.

Me and my bf are expecting, and we're excied but it took me coaxing. At first, I was concerned about how I would be able to take care of my child. I feel so bad for her! I thought at first she must have been drunk or something, and that was how he took advantage of her. It seems as if he preys on vulnerable, disabled women and impregnates them in order to keep them under his thumb.
I don't blame the girl one iota for not wanting to carry his child to term. This man sounds like a sick, scary psychopath, and the best thing she could have done was cut all ties with him.
If she had his baybee, she would never have gotten rid of him. The fact that he poked fun at her disability and posted intimate pics of her on the web, makes him a sadist of the worst kind, and lower than dirt. I, for one, am glad to hear that she didn't propegate his sickening seed.

What's really fucked up about this is it does seem she was willing to have the kid and let him raise the child. But he wasn't content to merely get custody of the kid, he wanted her raising the kid with him whether she wanted to do that or not. Even more fucked up when you consider the gap in age and life experience an 18 year old & 33 year old have.

I'm pro-choice and even though I'm CF, as long as someone respects the right to keep abortion legal, I can understand if they choose to have a child and put the child up for adoption or let the other parent raise the child. IMO, this isn't about the kid, it's about controlling her and keeping her under his thumb. I think the child was just a means to that end. I wouldn't be surprised at all if he deliberately lied to her about being sterile to try and trap her into staying with him.

Another fucked up part of this is had the pregnancy not terminated, whether through miscarriage or abortion, this guy probably wouldn't have been challenged on custody of the kid as he'd be the biological father. Can you imagine him raising a kid? Scary.
